Job Description

Role Summary

The Fiduciary Manager will leverage their specialized skills and experience to provide strategic and regulatory support to Private Clients practice.

Responsibilities

  • Complete all aspects of Estate and Trust administration including:
    • Direct working relationship with appropriate Partner, Associate, Estate Administrator and Clients.
    • Create agendas, coordinate, and attend client meetings; preparation of correspondence and memorandums; establishment, organization and maintenance of Trust and Estate files.
    • Preparation and filing of all Probate documents, knowledge of Surrogate's Court procedures.
    • Review and organization of decedents records and income tax returns; marshalling assets; collection and valuation of assets for estate tax purposes, closing accounts and opening estate accounts.
    • Collection and direct communications with life insurance carriers, annuity and retirement account companies, banking, brokerage and financial investment professionals.
  • Maintain master tax timetables and spreadsheets for estate, gift and fiduciary income tax filing deadlines for estates and trusts.
  • Work directly with tax accountants discussing tax elections and income tax planning related to Federal and State estate and income tax returns; secure and provide tax accountants with documentation and information required to complete income tax returns.
  • Preparation of all Federal and State Estate tax and Inheritance tax returns for US resident and Non-resident aliens, in accordance with the various tax laws of the appropriate jurisdictions and international treaties.
  • Preparation and filing of Federal and State Applications for Extension of Time to File and Pay estate or gift taxes.
  • Preparation of Federal and State Application for Releases of Liens.
  • Calculate executor and trustee commissions.
  • Maintain estate accounts and arrange payment of expenses and liabilities; coordinate and monitor purchases and sales in investment accounts for estates and trusts.
  • Coordinate filing and review of Federal and State Fiduciary Income tax returns in accordance with the various tax laws of the appropriate jurisdictions.
  • Coordinate payment of annual and ongoing estimated quarterly Federal and State fiduciary tax payments for Estates and Trusts.
  • Preparation of Federal gift tax returns, prepare and maintain ongoing schedules of available lifetime and GST exemptions.
  • Legal research related to the Trust and Estate area utilizing various hard sources and computerized search services, such as Dow Jones, Lexis, ICLI data-base.
  • Preparation of judicial and non-judicial Estate and Trust Accountings; knowledge of Surrogate's Court procedures and requirements for filings and required filing formats for Accountings; file Accountings and work with the Attorney General's office on estates or trusts with charitable beneficiaries.
  • Coordinate preparation of Account Approvals and Receipt, Release and Indemnification Agreements; and attendance at IRS and State audits and negotiations at same.
  • Estate and Trust financial planning; calculate and coordinate distributions of estate and trust assets; opening beneficial trust accounts.
  • Prepare and file IRS forms, including but not limited to Forms SS-4, W-9, W-8Ben, 2848, 56, Applications for Release of Lien and various State corresponding forms.
  • Coordinate transfer of residuary assets to remaindermen and closing estates and trusts.
  • Prepare and release diaries.
  • Other duties as assigned.

Education & Experience
  • At least five years of Trust and Estate legal assistant experience with knowledge of all aspects of Administration, Tax and Court procedures and at least three years of experience as a Senior Legal Assistant in the same areas.
  • A Bachelor's Degree in Accounting or Business Science.

Physical Activity/Other Miscellaneous
  • Flexibility to work outside standard business hours.

Shearman & Sterling's compensation is merit-based. The good faith, annualized salary range for this position is $140,000 to $180,000 depending on the candidate's overall experience and other job-related factors permitted by law such as, education, training, other responsibilities. The annual salary range listed is just one component of Sherman & Sterling's total compensation and benefits package which includes a discretionary bonus, paid leave, life, health, accident and disability insurance; and a 401(k) plan.
