Import Export Compliance Specialist with ITAR Experience

SUMMARY

The Import/Export Compliance Specialist will develop and deploy our Import and Export (IMEX) Compliance Program, including compliance for goods, software, technical data and services. This position is responsible for implementing appropriate compliance policies and procedures at all sites. They ensure proper export control processes are followed and appropriate licenses or agreements are obtained. They will assess the level of compliance, determine countermeasures and implement actions that ensure legal compliance. Although they will be responsible for identifying potential compliance issues, the major focus is the remediation of any potential issues. They interface with the Bureau of Industry and Security (BIS), US Customs and Border Protection (CBP), US State Department (DDTC), US Treasury Office Foreign Assets Control (OFAC) and other government agencies regarding company goods, software, technical data and services on compliance, licensing, and jurisdictional matters. This position will be remote with on-site requirements for the West Chester, PA facility.

Essential Duties and Responsibilities

• Serves as the Portescap expert on import and export requirements and ensures company policies conform to Altra Corporate IMEX Policies.
• Develops, executes, maintains, and implements import and export compliance policies and procedures.
• Analyzes and interprets requirements for compliance as they relate to:
  • International Traffic and Arms Regulations (ITAR) of the US Department of State;
  • Export Administration Regulations (EAR) of the US Department of Commerce Bureau of Industry and Security (BIS),
  • US Treasury Office of Foreign Assets Control (OFAC),
  • US Customs and Border Protection (CBP),
  • Census Bureau, and
  • other applicable government agency rules and regulations.
• Perform and manage risk assessments of company's IMEX compliance program to ensure all subsidiaries worldwide are following company policies and implements corrective actions at each site with local teams to ensure compliance
• Provide direction to business associates and resolve matters pertaining to export, re-export and deemed export/re-export transactions to ensure compliance with all applicable export laws and regulations
• Determine proper tariff classifications, valuation, and country of origin/marking of imported merchandise, as well as evaluate tariff preference program and free trade status of the same, such as chapter 98, NAFTA and other free trade agreements
• Develop and deploy import compliance procedures and record retention policy (including cross functional processes)
• Oversee and provide guidance to the export compliance team in day-to-day compliance matters which are not limited to but include customer and transaction screening, ECCN classification, export license determination and drafting license and agreements applications through the applicable government agency
• Oversee interactions with engineering, project management, and procurement divisions to analyze and apply proper export classifications to new products and technology
• Maintains compliant export files to support licensing and classification determinations
• Provides export compliance material for new-hire orientation program
• Develop and deploy training for proper tariff classifications of exported merchandise, as well as evaluating tariff preference program and free trade status of the same, for example, NAFTA, and other free trade agreements
• Travels to domestic and international Portescap sites to assess and improve all aspects of IMEX compliance
• Consults with General Counsel as needed to resolve difficult legal compliance issues related to companies import/exports

Education and Experience Requirements

• ITAR experience required
• Bachelor's degree in relevant area
• 3 or more years' experience in export administration experience
• Extensive knowledge of US export and import control laws and regulations as they relate to:
• Extensive understanding of applicable export, re-export, deemed export and deemed re-export licensing requirements
• Required to be a US resident
